TERMS OF SERVICE

These Terms of Service (“Terms”) govern the relationship between you and Blazing Heart Studio (“Company,” “Us,” or “We”) regarding your use of Blazing Heart Studio’s games, store, websites, and related services (the “Service”). Use of the Service is also governed by Blazing Heart Studio’s Privacy Policy and other relevant policies, which are incorporated herein by reference.

By accessing or using the Service, including browsing any Blazing Heart Studio website or accessing a game, you must agree to these Terms and the Privacy Policy. A guest account may be created for you to use the Service, and you may also be required to register an account (“Account”). By using or registering for an Account, you affirm that you are of legal age in your country of residence. If you are not, your legal guardian must review and agree to these Terms.

BY INSTALLING, USING, OR OTHERWISE ACCESSING THE SERVICE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT INSTALL, USE, OR OTHERWISE ACCESS THE SERVICE.

Blazing Heart Studio reserves the right to modify these Terms, its Privacy Policy, and other relevant policies at any time by posting the updated terms on the Service. Your continued use of the Service will be deemed acceptance of the updated terms.

1. Using the Service

1.1 Your Right to Use the Service

Subject to your agreement and compliance with these Terms, Blazing Heart Studio grants you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited right to access and use the Service for your personal, non-commercial entertainment purposes.

The following restrictions apply to the use of the Service:

• You are responsible for any unauthorized use of the Service by minors.
• You shall not buy, sell, rent, or transfer your Account.
• You shall not use the Service for commercial advertisements, spamming, or misleading messages.
• You shall not create an Account using false information or impersonate another person.
• You shall not use the Service if you have been previously banned from a Blazing Heart Studio game.

1.2 Use Limitations

You agree not to:

• Use cheats, exploits, automation software, emulators, bots, hacks, or any unauthorized third-party software.
• Modify any files that are part of the Service.
• Disrupt the normal flow of the Service or negatively affect other users’ experiences.
• Attempt to gain unauthorized access to the Service or another user’s Account.
• Post offensive, defamatory, or otherwise inappropriate content.
• Harass, abuse, or harm other users or Blazing Heart Studio employees.
• Engage in any gambling, betting, or similar activities within the Service.
• Violate any applicable laws or regulations.

Blazing Heart Studio reserves the right to determine what conduct violates these Terms and may take action, including Account termination.

1.3 Suspension and Termination of Account

Blazing Heart Studio may suspend or terminate Accounts without notice for violations of these Terms or suspected illegal or improper use. If your Account is terminated, you will lose access to any associated virtual items, progress, or benefits, and Blazing Heart Studio is under no obligation to compensate you.

2. Ownership

2.1 Games and Service

Blazing Heart Studio retains all rights, title, and interest in the Service, including but not limited to its games, content, and intellectual property.

2.2 Accounts

Your Account is owned by Blazing Heart Studio. You have no ownership or property rights in your Account.

2.3 Virtual Content

All virtual items, currency, and features in the Service are owned by Blazing Heart Studio. You have no ownership rights to virtual items, even if you purchase them.

3. User Content

3.1 Submission of User Content

You are responsible for any content you submit to the Service. You grant Blazing Heart Studio an irrevocable, perpetual, worldwide license to use your submitted content.

3.2 Content Screening

Blazing Heart Studio reserves the right to review, monitor, and remove any User Content at its sole discretion.

3.3 User Interactions

You are solely responsible for your interactions with other users. Blazing Heart Studio reserves the right to intervene but assumes no responsibility for user disputes.

4. Purchases and Fees

• Virtual items are non-refundable and non-transferable.
• Blazing Heart Studio may modify or remove virtual items at any time without compensation.
• Any purchases are final and do not guarantee access to content indefinitely.

4.2 Payment of Fees

Blazing Heart Studio is not required to provide refunds except where required by law.

INTERNATIONAL DATA TRANSFERS

As our Service is global, your data may be transferred internationally. We implement appropriate safeguards, such as EU Standard Contractual Clauses, to ensure compliance with data protection regulations.

5. Updates to the Service

Blazing Heart Studio may update the Service at any time, which may require you to install updates to continue using the Service.

6. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. Blazing Heart Studio does not guarantee uninterrupted or error-free service.

7. Limitation of Liability

To the maximum extent permitted by law, Blazing Heart Studio shall not be liable for any indirect, incidental, or consequential damages. If you have not paid Blazing Heart Studio anything in the past six months, your sole remedy is to discontinue using the Service.

8. Dispute Resolution

If you have a dispute with Blazing Heart Studio, you agree to resolve it through arbitration or mediation, where applicable, instead of litigation.

9. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect.

10. General Provisions

• Assignment: Blazing Heart Studio may assign its rights under these Terms without your consent.
• Entire Agreement: These Terms constitute the entire agreement between you and Blazing Heart Studio regarding the Service.
• No Waiver: Failure to enforce any provision does not constitute a waiver.
• Notices: Blazing Heart Studio may notify you through postings, email, or other communication means.
